Terms of Service

Welcome to Bookshift! These Terms of Service ("Terms") govern your use of the Bookshift website and services (collectively, the "Service"), operated by David Ellis ("we," "us," or "our"). Please read these Terms carefully before using the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. The Service

Bookshift provides a platform for users ("you") to submit manuscripts for AI-powered translation. Manuscripts are processed using our automated translation system with advanced quality checking. The Service includes file upload, credit-based cost calculation, payment processing via Stripe, and automated delivery of translated files in multiple formats.

2. User Accounts

To use certain features of the Service, you must register for an account using Google OAuth. You are responsible for safeguarding your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Submissions and Content

You may submit manuscript files in the formats specified on the submission form (e.g., .docx, .txt). You represent and warrant that you own or have the necessary rights and permissions to submit the content and authorize its translation.

IMPORTANT: You retain full ownership and all intellectual property rights, including copyright, to your original manuscript and any translations produced by the Service. Bookshift claims absolutely no ownership or copyright over your submitted content or the resulting translations. Our use is solely limited to providing the translation service you requested.

You agree not to submit any content that is illegal in your jurisdiction, or in Spain. "Adult" content is permitted as long as it does not contrevene US federal or Spanish national law.

4. Payment

The Service operates on a credit-based subscription system. Credits are purchased through monthly subscription plans or one-time credit packages. One credit equals one word of translation. Credits never expire and can be used across all our services including book translation and cover translation/generation.

Payment is required in advance via Stripe. By providing payment information, you authorize us (through Stripe) to charge the specified amount for your chosen subscription or credit package. All payments are subject to Stripe's own terms and conditions.

5. Service Delivery

Translations are now fully automated using advanced AI technology with comprehensive quality checking processes. Typical turnaround time is 10 to 30 minutes for most translations, though we recommend allowing up to 24 hours for completion. You will be notified when your translation is ready for download. While our automated system includes extensive quality assurance measures, we recommend reviewing the final translation as with any translated content.

6. Data Usage and Privacy

Your privacy is important to us. Our use of your personal information and manuscript data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Crucially, we commit that your submitted manuscript data will NOT be used for training any AI models beyond the specific tools used for your translation job, nor will it be sold or shared with unrelated third parties. Please see our Privacy Policy for full details.

7. Prohibited Conduct

You agree not to use the Service:

  • For any unlawful purpose or in violation of any local, state, national, or international law.
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate outside of fair and reasonable protected use such as parody and/or satire.
  • To submit false or misleading information except for legitimate purposes such as parody and satire.
  • To upload or transmit viruses or attempt to extract website code or LLM prompts, or any other type of malicious or nefarious code or content.
  • To interfere with or circumvent the security features of the Service.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of the Service or the translations produced. We disclaim all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

In no event shall David Ellis, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms shall be governed and construed in accordanceance with the laws of Spain, without regard to its conflict of law provisions, and specifically the regulations applicable in Santa Cruz de Tenerife.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect, likely via email or a notice on the Service. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
